Ethical veganism protected under the European Convention on Human Rights

On 16 July 2026 the European Court of Human Rights ruled in G.K. and A.S. v. Switzerland that ethical vegan convictions can fall within Article 9 of the Convention. The applicants — in pre-trial detention and a psychiatric hospital — depended entirely on the state for food and never received a merits decision on vegan-meal requests; domestic courts dismissed appeals on formal grounds. The Court found violations of Articles 9 and 13: states have a positive duty to examine such requests on the merits and balance them against real organisational limits — not an automatic right to fully vegan meals on demand, but vegan complaints cannot be brushed aside. The judgment also underlines that a vegetarian meal is not automatically vegan.
